By downloading, accessing, or using Memorial Photo Animator (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
Memorial Photo Animator allows you to create AI-animated videos from your photos. The service:
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.
You agree to:
Your Content: You retain ownership of photos you upload. However, by uploading, you grant us a limited license to process and animate the image for delivery to you.
Our Content: The App, its features, and all resulting animations are owned by DeadApp. You receive a personal, non-commercial license to use, save, and share animations you create.
Payment: Payment is processed through Apple App Store for each animation created.
Refunds: Refund requests must be made through Apple App Store in accordance with their refund policy. We do not process refunds directly.
Service Failures: If animation generation fails due to technical issues, we will either retry the generation or refund the payment through Apple.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEADAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless DeadApp from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

We reserve the right to modify or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where DeadApp operates, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DeadApp regarding your use of the App.
